Koloist Comment Policy
We welcome your comments. Please note that we may, at our sole discretion, remove comments if they are deemed unrelated or inappropriate.
Postings and other communications with Koloist.com (hereafter referred to as KOLOIST, KOLOIST Site, or Site) are not private and may be published and edited at the discretion of KOLOIST unless specifically instructed otherwise.
Koloist Posting Guidelines
Kolo is a globally recognized and respected brand. We strive to uphold its reputation. As such:
1. KOLOIST will not tolerate obscene, pornographic, libelous, deceptive, harassing, abusive, or inappropriate language or material on KOLOIST or its affiliated communities (i.e. no swearing or defamatory language).
2. KOLOIST will not tolerate any material that encroaches upon the rights of others, including expressions of bigotry, racism, or hatred.
3. KOLOIST will not allow personal attacks on fellow bloggers, Kolo customers, dealers or competitors.
4. Every entry should be both checked for factual accuracy. We reserve the right to edit submissions for clarity and brevity.
5. You will not post any content that infringes any copyright, trademark, service mark, patent, trade secret or confidentiality obligation.
6. You will not post any content or comment that advocates illegal activity.
7. You will not post or email any material that contains viruses, corrupt files, links or other content which may compromise KOLOIST or any user thereof, or that violates any laws or regulations of any governing body with jurisdiction over KOLOIST, its affiliates and users.
8. Remember that you can be held personally liable for any commentary that may be defamatory, proprietary, or libelous. Use your own best judgment with regards to exaggeration, inappropriate language, copyrighted materials, legal conclusions, veracity and derogatory remarks or characterizations. You can be held legally responsible for your postings.
9. Never disclose any confidential or proprietary information about KOLOIST, Kolo, its distributors, dealers, vendors or customers.
10. Always provide the proper attribution/link to other sites that you mention.
Submission Guidelines
If you would like to submit an article, the following are our submissions guidelines. These also apply to photographs, video and other artworks.
There are usually no deadlines for submission unless it is for thematic purposes. Please note that despite our namesake, KOLOIST will consider submissions on general album-making themes and other brands of photo albums.
1. Send in a maximum of one essay, commentary or five poems at a time. A 500-1,000 word limit is suggested. We will consider short stories. If you would like to submit one, query first via email with a summary of the work.
2. We will accept submissions by email only. We ask that you please send the text of your query or submission in plain text in the body of your e-mail, rather than as an attached file (however MS Word is acceptable), as we may not be able to read the format of your file. If you wish to contribute, please spend some time familiarizing yourself with KOLOIST's various categories and features.

Please type "EDITORIAL SUBMISSIONS" in the subject line of the e-mail. Please tell us a bit about yourself -- your experience and background as a writer and qualifications for writing a particular story. If you have clips you can send us by e-mail, or Web addresses of pages that contain your work, please send us a representative sampling (no more than three or four, please).
3. Upon acceptance, writer grants KOLOIST one-time publication as well as one-time anthology rights. Writers retain copyright ownership of their work and can publish it in print anytime. The piece will be featured in the main section of the website for a maximum of 2 days or until the current page cycles out. At that time, the work will be placed in the archives where it can be accessed by readers.
4. Simultaneous submissions are permitted. Reprints are also welcome. Please include all the necessary attributions, copyright notices and link URLs.
5. We do our best to promptly respond to all queries, but be aware that we are sometimes unable to do so. If you have not heard back from us after four weeks, please assume that we will not be able to use your idea or submission.
6. Photos, illustrations and videos are also welcome. Please do not send copyrighted images other than your own. Captions are required.
7. If mailing is needed, all submissions must be accompanied by a self-addressed envelope with appropriate return postage if you wish your submissions to be returned. Email us for the address.
8. KOLOIST does not offer financial compensation for material.
9. If you want to be featured on KOLOIST, please send a short bio, an image of your album (photo box or other similar or related project) in your setting and caption. Business and other commercial updates and product news should be clearly labeled.

1. General
You should assume that all material on KOLOIST is protected by copyright unless otherwise noted and may not be used except as permitted in these Terms and Conditions or in the text on KOLOIST.
2. Disclaimer of Warranty
Your use of the KOLOIST site is at your risk. KOLOIST makes no warranties or representations as to its accuracy and KOLOIST specifically disclaims any liability or responsibility for any errors or omissions in the content on the Site. Neither KOLOIST, its parent or affiliated companies, nor any other party involved in creating, producing, or delivering the KOLOIST Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, or inability to use or access, the KOLOIST Site. Without limiting the foregoing, everything on the KOLOIST Site is provided to you "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties.
3. Features and Specifications
Features and specifications of products described or depicted on the Site are subject to change at any time without notice. Product dimensions and measurements are approximate.
4. Risk of Use
KOLOIST assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the KOLOIST Site or your downloading of any materials, data, text, images, video, or audio from the Site.
5. Use of Ideas
If you send any communications or materials to the KOLOIST Site by electronic mail or otherwise, including any data, questions, comments, suggestions, or the like, all such communications are, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by KOLOIST, its parent and/or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, KOLOIST, its parent and its affiliates are free to use, without any compensation to you, any ideas, concepts, know-how, or techniques contained in any communication you send to the KOLOIST Site for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products using such information.
6. Ownership of Materials on Site
Materials displayed on the KOLOIST Site are either the property of, or used with permission by, KOLOIST. The downloading or use of these materials by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission is provided. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and civil and criminal statues.
7. Product Availability
The KOLOIST Site refers to products and/or services that are generally available for purchase in the whole world but may not be available in your particular country or locality. The reference to any such products or services in this Site does not imply or warrant that these products or services will be available at any time in your particular locality. You should therefore check with your local Kolo authorized representative for specific product/service availability in your locality.
8. Links to/from other Sites
KOLOIST is not responsible for the content of any site linked to or from the KOLOIST Site. Your linking to any other site is entirely at your own risk. While KOLOIST may provide links on this Site to other sites, the inclusion of such links is for your convenience only and should not be interpreted as an endorsement of the owner/sponsor of the site or the content of the site. KOLOIST disclaims all warranties, express and implied, as to the accuracy, validity, legality or otherwise of any materials or information contained on such sites.
9. Postings on the Site
Although KOLOIST may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards and the like on the Site, KOLOIST is under no obligation to do so and assumes no responsibility or liability arising from the contents of any such communications nor for any error, defamation, libel, obscenity, profanity, or inaccuracy contained in any such communication. You are prohibited from posting or transmitting any unlawful, threatening, defamatory, libelous, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law. KOLOIST will fully cooperate with any law enforcement authorities or court order requesting or directing KOLOIST to disclose the identity of anyone posting such materials.
10. Copyrighted Material
KOLOIST respects the intellectual property of others, and requires that its users do the same. Accordingly, you may not place any material protected by copyright anywhere on the KOLOIST Site without the express permission of the author or owner of the copyright in that material.
KOLOIST will promptly take down or block access to infringing or allegedly infringing material on its servers if KOLOIST becomes aware that such material infringes the copyright rights of a third party, whether KOLOIST identifies such infringement in the course of its ordinary and reasonable business activities, or through notification by a third party.
If you believe that your work has been copied in a way that constitutes copyright infringement, and appears on the Site, please contact KOLOIST.
11. Changes to Terms and Conditions
KOLOIST may at any time revise these Terms and Conditions by updating this posting. Since your are bound by these Terms and Conditions, you should therefore periodically visit this page, by clicking the Policies hyperlink at the top of the KOLOIST Web home page, to review the then current Terms and Conditions.
12. Copyrighted Material
All material on the KOLOIST Site and presented via the Viewer, including, without limitation, text, software, photos, video, graphics, music and sound, are protected by international copyright laws, both as individual works and as a collection. Users may not copy, reproduce, retransmit, distribute, publish, commercially exploit, or otherwise transfer any such copyrighted material in any format, electronic or otherwise. Any material protected by copyright may not be placed on the Site without the express permission of the author or owner of the copyright on that material. If KOLOIST becomes aware of the presence of copyright infringing material on its server either in the course of its ordinary and reasonable business activities, or through notification by a third-party who alerts KOLOIST, through an appropriate notice as required under Copyright Law, of the specific location of the alleged presence of such materials, KOLOIST will: - Promptly take down or block access to the allegedly infringing material; and - Contact the user responsible and alert him or her of the allegations of copyright infringement and of KOLOIST’s removal or blocking of the allegedly infringing material. If the User believes that the removal or blocking of his or her material was a result of a mistake or a misidentification of the material, the user shall provide KOLOIST a counter notification establishing the user's rights to display the material in question, as well as any other information KOLOIST shall request. Upon receipt, KOLOIST will promptly forward the counter-notification to the party that claims to be the copyright owner. If that party then does not file suit to enjoin the alleged infringement, KOLOIST will re-post or unblock the material within 10-14 business days.
13. Limitations of Liability and Warranty
The User agrees that the use of the Site is entirely at the User's own risk. The Site is provided on an "as is" basis without warranties of any kind, either expressed or implied. Furthermore, neither KOLOIST nor any third-party content provider makes any warranty with respect to any content, information, services, or products provided through or in conjunction with the Site. The User specifically agrees that KOLOIST or third-party content providers are not liable for any conduct by Users associated with the Site. KOLOIST and third-party content providers make no guarantee of the accuracy, correctness, or completeness of any information on the Site and are not responsible for(i) any errors or omissions arising from the use of such information; (ii) any failures, delays, or interruptions in the delivery of any content or services contained within the Site; or (iii) losses or damages arising from the use of the content or services provided by the Site.
14. Indemnity
A User agrees to indemnify KOLOIST and any third-party information provider against any and all claims and expenses, including attorneys' fees, arising from the User's use of the Site. This expressly includes: (i) User's responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and
(ii) any libelous or unlawful material contained within User profiles, or Postings.
15. Termination of Service
KOLOIST may terminate Usership and any and all information, communications, or Postings, at any time, without notice, for conduct that violates this Agreement or other policies or guidelines set out by KOLOIST elsewhere on the Site. KOLOIST may terminate Usership and delete any and all information, communications, or Postings for online conduct that KOLOIST believes is harmful to other Users, the business of KOLOIST, or other third-party information providers.
16. Merger Clause
This Agreement constitutes the entire agreement between the parties with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between KOLOIST representatives and the User. KOLOIST may amend this Agreement at any time with notice from KOLOIST to the User as published on the Site.
Online Privacy Policy :
Your Privacy
We believe our online visitors have a right to know our practices regarding the information we may collect when you visit our Web sites and what type of information is collected. The guidelines contained herein apply only to your visit to the Web sites operated by or for KOLOIST and the entities it controls.
While KOLOIST does not generally require that you provide us with personally identifiable information in order to visit and use the KOLOIST Site, please note that in order to participate in some activities, it will be necessary for you to provide this information. If you choose not to provide it for those activities, you may not be able to participate in them.
Collection of Information:
For each visitor to the KOLOIST Web site, KOLOIST's Web server automatically recognizes, collects and/or stores information such as the visitor's IP address/Domain name combination and any referring sites. KOLOIST may use several technologies to accomplish this.
KOLOIST may ask you to provide "personal information", meaning individually identifiable information such as your email address, name, mailing address, telephone number to enable you to participate in contests, chat rooms, on bulletin boards, to fill out a registration, or to order products and services using these sites. KOLOIST may combine the information you provide on our Web sites with information we may collect offline from you so that we can more effectively tailor our site, services and offerings to you.
Unless you instruct us otherwise, KOLOIST may contact you to provide information about products, services, promotions, contests, or other activities or offerings that may be of interest to you. You can instruct us whether or not you wish to be contacted by checking or unchecking the box in your registration process, or by clicking here and providing the requested information. In addition, with each communication you receive from KOLOIST, you will be given the opportunity to indicate if you do not wish to receive future communications.
KOLOIST will not share the personal information you provide on the KOLOIST Web sites with any other parties, except (a) with your consent (see paragraph below), (b) as may be permitted or required by law or court order, (c) to persons or companies with whom KOLOIST contracts to carry out the operations of the site or our business, or (d) under exigent circumstances to protect the personal safety or property of our users, the public or ourselves.
Security:
KOLOIST takes great care in maintaining the security of your personal information and in preventing unauthorized access to it through the use of appropriate technology and internal procedures. However, KOLOIST does not guarantee that unauthorized access will never occur.
Copyrights & Usage Agreement for Images Uploaded to KOLOIST :
When you upload an image to KOLOIST, you grant the us a non-exclusive, world-wide, royalty free license to modify, publish, and reproduce your material solely for the purpose of displaying, distributing, and promoting KOLOIST.
Therefore, in addition to the specific application to which you directly upload, your pictures could be used in online galleries, camera microsites, e-mail newsletters, press releases, and the like. Uploaded images are subject to the stated uses at any time, without prior permission and with no termination date.
KOLOIST does NOT take ownership or copyright of the images that you upload. You retain full ownership, and your pictures are free for you to use in any application that you choose - artistic, commercial, or personal. At the same time, we retain the option to continue using your images on KOLOIST, in accordance with our stated rights.
Moreover, KOLOIST does not assume the rights to sell or distribute your images to any third party without your permission.
